Slovakia residence permit renewal: živnosť, s.r.o., family
Current as of September 2026, based on Act No. 404/2011 Coll. on the Residence of Foreigners as in force from 15 July 2026. Section numbers refer to that Act; the practice of individual foreign police departments changes faster than the law, so check minv.sk before you file.
Renewing a temporary residence permit in Slovakia (obnovenie prechodného pobytu) is simpler than the first application, but it is the moment when the foreign police check whether you actually pursued your residence purpose. A živnosť holder has to show income, an s.r.o. director the tax the company paid, an employee that the job is still theirs, a family member that the family lives together. Below: when to file, what to prove for each purpose, how long the decision takes, and the small things that cost people their status.
When to file
The renewal application is filed in person at a foreign police department or through the interior ministry’s electronic service no later than the last day your permit is valid (§ 34(2)). The one exception is seasonal employment under § 23(4), where the deadline is 30 days before expiry.
What filing on time gives you: from the day the card expires until the decision, your stay is considered lawful (§ 34(16)). You keep working, running the business and living at the same address, holding the confirmation of receipt the police issue on the day of filing (§ 34(2), last sentence).
What happens if you miss it: the law does not provide for a renewal application filed after the last day of validity. The permit ends on expiry (§ 35(c)), and what follows is a fresh residence application with the full file, apostilles and — for business — a check whether your company paid tax for the previous period (§ 33(6)(j)). So the target is not “the last day” but two to three months before: a criminal record certificate is not needed for renewal, but proof of accommodation, insurance and income takes more than a week to assemble.
A practical note: appointment slots in the interior ministry booking system open shortly before the date and go quickly. If there are no slots and the deadline is close, go to the department with a complete file: the law ties acceptance to the deadline and a valid passport (§ 34(2)), not to a booking — but ask your department in advance how it handles walk-ins.

The periods come from § 33(8) and apply to renewals directly (§ 34(14)). For employment, the 60 and 30 days run from the day the application arrives with all attachments.
Documents
General list
- A valid travel passport — without it the application is not accepted (§ 34(2)).
- The official application form and a photograph.
- Documents not older than 90 days confirming (§ 34(3)):
- the purpose of stay — not needed if the facts proven at the first application are unchanged (point (a));
- financial means — business only (point (b)): a statement of the balance in an account in your name, 12× the subsistence minimum (§ 32(6) and (14); in 2026 that is €3,543);
- health insurance — except for employment and study (point (c));
- accommodation — except for the listed exemptions: cross-border commuters, university students, researchers, families of major investors and so on (point (d)).
- Administrative fee. According to MIC IOM data as of July 2026, renewal costs €100, €140 or €200 depending on the period you are renewed for; filing electronically reduces the fee by 50%, up to a maximum of €50. Check the exact amount for your case at the department.
A criminal record certificate is not on the § 34 list — a difference from the first application. Nor is the infectious diseases report: that obligation is tied to receiving the card (§ 32(10)).
Accommodation
Proof of accommodation follows § 122(1). Since 15 July 2026 the list looks like this:
- the electronic consent of the property owner or accommodation provider, submitted through the interior ministry’s e-service (point (a)) — the new option;
- a lease with the owner or user of the property plus a document proving the right to use it (point (b));
- confirmation from a hotel or hostel (point (c));
- a sworn statement by an individual or a company providing accommodation, plus the document on the right to use the property (point (d));
- the landlord’s sworn statement that the lease is still valid (point (e)) — if you showed the same lease to the police in a previous procedure and it remains valid for at least six more months. This is the most convenient option for a renewal: no new lease is needed.
Accommodation must be secured for at least six months of the stay (§ 32(8)). For family reunification you prove shared accommodation with the sponsor. How to get a lease done properly is covered in our article on renting a flat in Slovakia.
If something is missing
At renewal the law gives you 30 days to supply missing documents, and the police may extend that by 15 in justified cases (§ 34(4)). Miss it and the proceedings are discontinued, with no appeal against that decision. Note that the rule does not work for electronic filing: an application without the complete set is simply not accepted (§ 34(2)).
How long the decision takes
By law (§ 33(8) via § 34(14)):
- 90 days — the general period: business, family reunification, study, special activity;
- 60 days — employment (§ 23(1)), from the day the application with all attachments arrives;
- 30 days — employment in an occupation on the regional shortage list where the employer meets the statutory condition; the family of an EU Blue Card holder; a few other categories.
In practice the police often use the full period, and supplying documents under § 34(4) effectively pushes it back. Do not count on “a month” — plan for the full period. Your status is lawful while the case is pending (§ 34(16)), but leaving the Schengen area and returning on an expired card is a separate risk: the confirmation of receipt does not replace a residence permit at the border, so clarify your case with the police beforehand.
If the application is granted there is no written decision: the police send a notification with the renewal date and the new expiry date (§ 34(15)) and then issue the card.
How long the renewal is granted for
Maximum renewal periods are set in § 34(1):
- up to three years — where the expected stay will last at least three years (point (c)); this is the ceiling for business;
- up to five years — for employment (§ 23), study (§ 24) and family reunification (§ 27), where the expected stay will last at least five years (point (d));
- up to 240 days within 12 months together with the previous period — seasonal employment (point (a));
- nine months — for graduates of Slovak universities and researchers looking for a job or starting a business (point (b)).
The actual period follows your documents: a one-year employment contract means a one-year renewal, not five. For family reunification the period cannot exceed the sponsor’s permit (§ 27(5)) — if the sponsor’s card has a year left, the family gets a year.
Typical mistakes
- Filing after the last day of validity. The stay becomes unlawful and the “renewal” turns into a new application with the full file. Aim for two to three months before expiry.
- A živnosť holder below the income threshold, or no tax return filed. § 34(5) requires taxable income from the business in the previous tax period above the sum at which a tax return becomes mandatory (§ 32(1) of Act 595/2003; for 2025 income that is €2,876.90). - The s.r.o. has not paid tax, or has arrears. The director proves the company paid tax at least equal to the daňová licencia (§ 34(6)), and arrears with the tax office, customs, social and health insurers are prohibited for business permit holders altogether (§ 111(10)) — the police revoke the permit on that ground even outside a renewal (§ 36(1)(f)). - A živnosť holder signed an employment contract. For a business permit, entering an employment relationship is a ground for revoking the stay (§ 36(1)(g)). A change of purpose is a separate application, not something that happens “in fact”.
- Less than half the year in Slovakia. A permit holder must spend more than half of the granted period in the country in each calendar year (§ 111(1)(t)); a breach is an independent ground to refuse renewal (§ 34(11)(b) referring to § 36(1)(d)). An absence of more than 180 consecutive days must be reported to the police in writing (§ 111(1)(a)).
- The employer did not request a new labour office confirmation. For an employment renewal the police do not accept the application without the confirmation, or with one older than 180 days (§ 34(2)). Get the employer moving a couple of months ahead — the labour office has its own timelines. The procedure is described in our article on the work residence permit.
- Spouses living apart. At a family reunification renewal the absence of a common family life is a direct ground for refusal (§ 34(13)). Do not register a “temporary” separate address without understanding the consequences.
What comes next: long-term residence after 5 years and the A2 exam
Five years of lawful, continuous residence immediately before filing is the condition for long-term residence (dlhodobý pobyt, § 52(1)(a)). It is a status without a time limit, and the years on employment, business and family permits lead there. The details:
- Study counts as half (§ 52(5)(a)), and you cannot apply for long-term residence while holding a study permit (§ 52(2)(f)) — change the purpose first.
- Temporary protection: under the Bureau of Border and Alien Police guidance of April 2026, time spent as a temporary protection holder counts towards the five years — this is an internal instruction, not the text of the law, so check your own case before filing.
- A Slovak language exam at level A2 or higher (§ 52(7), § 54(4)) has been mandatory since 15 July 2025. Exempt: children under 14, persons under § 29, and those who studied for at least two years at a Slovak-language school or university no more than five years ago.
- The decision takes up to 90 days (§ 53(7)); documents not older than 90 days cover stable income, accommodation and insurance (§ 53(3)).

Frequently asked questions
Can I file for renewal on the last day?
Yes, the law allows filing “najneskôr v posledný deň platnosti” (§ 34(2)), and from that moment your stay is lawful until the decision (§ 34(16)). But the smallest error in the file costs you your safety margin, and after the last day you can no longer file.
Do I need a criminal record certificate for renewal?
It is not on the list of renewal documents (§ 34(3)). You need documents on the purpose, financial means (business only), insurance (except employment and study) and accommodation — all not older than 90 days.
What does a živnosť holder show: income or a bank balance?
Both. Business income for the previous tax period above the tax return threshold (§ 34(5)) and a bank balance of 12× the subsistence minimum (§ 34(8), § 32(14)). Plus no tax or contribution arrears (§ 111(10)).
How long does it take to renew a work residence permit in Slovakia?
Up to 60 days from the day the application with all attachments arrives, 30 days for shortage occupations (§ 33(8)(b), (c)). The employer must obtain a new labour office confirmation beforehand — without it the application is not accepted.
Can I renew my permit if I changed employers?
An employment permit is tied to a specific job position. The new employer goes through the labour office again and the police receive a fresh confirmation; at renewal these are the “changed facts” under § 34(3)(a). If the employer changed well before the renewal, the end of the original purpose should have been reported within three working days (§ 111(1)(n)) — check that this was done.
