How long does a Slovak residence permit take in 2026: times by type

Current as of September 2026, based on Act No. 404/2011 Coll. on the Residence of Foreigners as in force from 15 July 2026. The figures below are statutory decision periods; the practice of individual foreign police departments changes faster than the law, so check minv.sk before you file.

“How long does it take to get a residence permit in Slovakia?” is the most common question at a consultation, and there is a short answer: the law gives the police 90, 60 or 30 days depending on the purpose of stay. The long answer matters more. The clock does not start on the day you “submitted the documents” but when the police hold a complete file; a request for missing papers and the time spent collecting certificates push the final date back by weeks. Below: the statutory rule, a table by permit type, and what the timeline really depends on.

What Act 404/2011 says

The decision periods for a temporary residence application (prechodný pobyt) are set in § 33(8) of the Act on the Residence of Foreigners:

  • 90 days — the general period: business (živnosť and s.r.o.), study, family reunification, special activity;
  • 60 days — employment (§ 23(1)), counted from the day the application arrives with all attachments;
  • 30 days — employment in an occupation on the regional shortage list where the employer meets the statutory condition; the family of an EU Blue Card applicant is decided within the same period as the sponsor’s application (§ 33(8)(d)).

The same periods apply to renewals — § 34(14) refers directly to § 33(8). Long-term residence (dlhodobý pobyt) has its own rule: up to 90 days under § 53(7).

One important caveat: the law says “up to” everywhere. It is a maximum, not a promise — the police may decide sooner, but you should plan for the full period.

What the table leaves out: citizenship is not governed by the Residence Act. In our experience the procedure takes up to 24 months — a benchmark, not a statutory period.

What really happens after you file

The statutory period is the time for the decision. The real time from “I’m applying” to the card in your hand has three parts, and the police are responsible only for the middle one.

Before filing. The apostilled criminal record certificate, the lease, the insurance, the labour office confirmation — each document must be no older than 90 days on the day of filing, and the 90 days run from the issue date, not from the date of your police appointment. While the apostille and translation are under way, the certificates keep ageing. In our clients’ experience the whole permit process, including document collection, takes 2–4 months; long-term residence takes 2–6 months.

The police appointment. Slots in the interior ministry’s booking system open shortly before the date and go quickly; for the temporary protection route the booking window opens at most 21 days ahead. Several weeks easily pass between “file ready” and “filed”, and none of them count towards any statutory period.

The decision itself. Three things stretch it most:

  1. An incomplete file. For employment, since 15 July 2026 the application is accepted even with some documents missing — provided you have a valid passport and a valid labour office confirmation — but you get 15 days to supply the rest, plus another 15 on request (§ 32(18)). At renewal it is 30 days plus 15 in justified cases (§ 34(4)). Miss it and the proceedings are discontinued with no decision on the merits. And because the 60 days for employment run from the arrival of the application with all attachments, supplying documents effectively restarts the clock.
  2. Opinions of other authorities. The police request the views of other bodies. On the temporary protection route the law gives them 30 days to object (§ 131o(13)); the general procedure has no separate figure, but the checks run in parallel and eat into the 90 days.
  3. Department workload. For employment, Bratislava often decides faster than the statutory period; the regions vary. You cannot influence this, and you should not plan around the fast scenario.

The good news: if a renewal is filed on time, your stay is lawful until the decision (§ 34(16)), and on the temporary protection route your protection status remains while the application is pending. The worst outcome is not a long wait but discontinued proceedings because of one certificate that was never delivered.

If the period has run out

First, check that the clock has actually started: if the police asked you to supply documents, the period runs from the complete file. Second, ask your department for the status: you hold a dated confirmation of receipt, and the police can tell you what stage the case is at. Third, do not leave the Schengen area on an expired card while the decision is pending: the confirmation of receipt does not replace a residence permit at the border.

If what arrived is a refusal rather than a decision in your favour, time is short: an appeal (odvolanie) is filed, as a general rule, within 15 days of service, counted in calendar days. Reviewing the refusal and preparing the appeal is a separate service, and the first thing we do is fix the date of service.

From which day do the 60 days for an employment permit run?

From the day the application with all attachments arrives (§ 33(8)). If the police accepted the application with some documents missing and gave you 15 days to supply them, the clock effectively starts once the file is complete.

Can the decision be expedited?

There is no statutory “fast track” for a residence permit. A shorter period applies only to shortage occupations (30 days) and to the family of a Blue Card applicant. The one thing that genuinely speeds things up is a complete file on the day of filing: no requests for documents, no restarted clock.

What should I do while waiting?

For a renewal: keep working and living as before — the stay is lawful until the decision. Once you receive the card you have 30 days to submit the infectious diseases report and show proof of insurance, so find out in advance where to get them. How long do permanent residence and citizenship take?

Long-term residence: up to 90 days under § 53(7), longer in particularly complex cases; permanent residence for an unlimited period: also 90 days, with your existing status valid until the decision.
